A long -awaited hearing on Tuesday has been set to determine whether two brothers who killed their rich parents could be liberated from prison after three decades in their mansion in Beverly Hills.
After months of delays, a judge will start hearing two days of arguments, both for and against Erik and Lyle Mendez’s offer to receive a lesser sentence – which can ultimately lead to their conditional release.
Prosecutors have argued that the brothers carefully planned the murders in 1989 to gain access to their parents’ fortune, have still not been accountable and may not be released. The brothers have said that they have acted out of self -defense after years of abuse.
The infamous matter, which has led to books, documentaries and dramas, still divides America.
During the two -day hearing, it will not be broadcast or streamed, the judge is expected to look at evidence, hear a witness from witnesses and ultimately determine whether the brothers, who have been convicted, should get a lesser punishment without the possibility of conditional release.
It is Expected to testimony a variety From people, including members of the Mendez family and possibly who are involved in the original case.
Erik and Lyle could even take the position, although such a movement would open them to questions from public prosecutors who oppose their release. The BBC has asked if they will witnesses or who else can be called to testify.
In an episode of his podcast, their lawyer Mark Geragos said he had not decided if she wanted to call them to the stand.
“I now know that I will put family members in the stands,” said Mr. Geragos. “I now know that I will put correctional officers in the stands. I know that I can now put behavioral scientists in the stands.”
The office of the public prosecutor did not say who intends to call witnesses.
The hearing will not be a repeat and the fault of the brothers will not be questioned.
Instead, much of the focus is probably on what they did during their 30 years in prison and whether they have been rehabilitated.
During their tests, prosecutors painted them as right and enthusiastic to gain access to the $ 14 million fortune of $ 14 million (£ 10.7 million).
They argued that the duo methodically planned the murders, buying shotguns and opening the fire on their parents 13 times while the pair watched TV – before gambling, parties and shops.
The brothers eventually admitted to the murders, but claimed that they acted out of self -defense after years of emotional, physical and sexual abuse by their father Jose, a powerful film and record label Executive.
The process of the brothers in 1993 was one of the first controversial murder cases that are shown live on television, the moving audience in the US and moving worldwide.
Their first process ended in an impasse, but in 1996 the brothers were convicted of murder in the first degree in a new process. Many of their sexual abuse claims were not allowed as part of the procedure.
The hearing comes after a Netflix drama has put the case back into the spotlight, and the support for the breeding of them comes in particular from the previous public prosecutor George Gascón in Los Angeles.
His replacement, Nathan Hochman, has strongly opposed the efforts of the brothers to be released and argued that they did not “have demonstrated real responsibility” and instead were clamped to a litany of “lies” about the case.
