Salem, nj – the family of the hockey player of the NHL Johnny Gaudreau and his brother Matthew listened on Tuesday in pain when lawyers discussed whether their own men’s drink contributed to their deaths when Were affected by allegedly drunk and angry driver when they walked through at night.
After almost two hours of argument, the judge agreed that the matter was according to criminal law in New Jersey – observance of all charges against drivers, including murders of killing and vehicle.
“There is no credibility in the argument that cyclists were contributing negligence,” said the judge of the High Court Michael Silvanio.
According to defense, Gaudreaus had a blood alcohol level of 0.129 or higher, higher than the statutory limit of 0.08 in New Jersey and the blood alcohol content of 0.87, which the police recorded for Sean Higgins. His lawyers hoped that killing and murder fees would reduce or release the vehicles.
“To say that their bac could contribute to the cause of death is at least a reach,” said prosecutor assistant Michael Mestern.
Other drivers told the police that the brothers were driving safely on the edge of the road, not weaving into operation, he said. The prosecutors accused Higgins of alcohol disturbance and drove road anger as they hit them.
“There are four witnesses who have witnessed that the defendant exceeded speed and illegally passed the bronco on the right side when he hit his brothers. Instead, Portella claimed that a large jury had not heard of all the facts before approved the accusation that she claimed that Higgins was deliberately ruthless and left the scene.
Mestern called the sound of the indictment and the judge agreed and sent the accusations to the court and planned another hearing on June 10.
Higgins faces a maximum of 70 years in prison if it is convicted of all numbers. His lawyers refused to offer a request for 35 years.
